TOTAL VICTORY

Today’s 72-25 vote in favor of cloture is a complete and total repudiation of a six-year strategy by Senate Democrats (and a twenty year effort by liberal legal thinkers like Laurence Tribe) to make ideology fair game in judicial confirmations. Senators face elections. They are the candidates. Judges do not face voters and should not have to act like baby-kissing politicians, crusading for votes. And today’s vote makes it clear that now and in the future, judicial nominees do not have to act like political candidates (or be treated like them) in order to be confirmed.

So today’s vote settles the question once and for all — every single qualified nominee who demonstrates a judicial temperament deserves and requires a fair-up-rdown vote on his or her nomination.

Today’s vote should also represent the final repudiation of the Democrats filibuster strategy. Voters have repudiated it at twice at the ballot box, making clear their distaste for obstruction. Finally, after six years, the Democrats caught on.

There’s lots of moaning tonight at DailyKos about needing more Democrats. But the Kossak’s whining proves they still don’t get it. By voting in favor of cloture, Democrats move away from their failed strategy and closer to winning elections. The pro-filibuster left just drags the Democratic party closer and closer to the Howard Dean fringe. So, the far-sighted partisan Republican in me knows that the fight in Washington will continue.

But for today, victory is ours, and we should celebrate it.

After getting pounded in a loss to the Cal Bears in Pauley Pavilion last Saturday, UCLA limped into the state of Arizona for their annual duo of duels in the desert. Thursday night's showdown took place in Tucson, where the Bruins had dropped eight straight against the surging Wildcats, fresh off their huge double overtime win over the highly esteemed Huskies in Washington. The odds did not favor the Bruins, but they scorched the McKale Center nets with a 60% shooting night and repelled a nail-biting last-minute Arizona rally for a 85-79 victory. Sophomore Center Lorenzo Mata's gritty play inside made Coach Ben Howland happier than an eBay seller with ten Rose Bowl tickets, especially since Howland's two senior centers are still unavailable due to injuries. Super sophs Afflalo, Shipp and a gimpy Jordan Farmar all posted double figure point totals, and the Bruins upped their record to 12-2, 2-1 in conference.

Surely the Bruins now stood an excellent chance at taking both games on the road trip, with the lesser Sun Devils hosting Howland's hotshot hoopsters on Saturday afternoon. After the first half in Tempe, there must have been at least a few bemused Arizona fans who were perplexed as to why the Bruins hit 17 of 25 first half field goal attempts against their Wildcats, but only made six of 25 against the Sun Devils. Trailing ASU 29-23 at intermission, the Bruins would certainly come out shooting better in the second half.

My personal coverage of the second half consisted of intermittent trips to the car and turning on AM 570, since our family was visiting with friends and the kids were playing outside. After hearing Jordan Farmar hit a clutch shot in the lane for a 59-57 lead with about half a minute left, I had to step away from the radio for a bit. Minutes later, I heard that the Bruins had pulled out a second road victory, 61-60, but was unaware of the details of the final seconds of the game. I relayed the final score to my wife minutes later, and as we rode home, I told her: "We were up, fifty-nine to fifty-seven and won, sixty-one to sixty, so I figure ASU probably missed their last shot, fouled one of our guys who made two free throws, then ASU probably hit a last second three-pointer to bring the final score within one." This seemed like a perfectly logical and plausible explanation.

"Either that, or ASU hit a three-pointer and then we scored again to win it," I continued to theorize, as that could have happened, too.

Turns out my second scenario, although much more dramatic, was indeed the one that played out. Sun Devil Bryson Krueger's 3-pointer had given the Sun Devils a 60-59 lead with 12 seconds to go, but Jordan Farmar, who aggravated his ankle injury Thursday in Tucson, drove the lane and hit a shot with 3.6 remaining. Sun Devil fans, who on Thursday saw their team lose to SC on a Trojan three-pointer with less than three seconds left in the game, have gotta be feeling worse than a mad cow with bird flu. (Comedian Dave Barry gets credit for that quip; I liked it so much I had to work it in here somewhere.) The Bruins, meanwhile, hadn't been twice victorious visitors in the Grand Canyon State since 1997, and presently share first place in the Pac Ten with Cal (who lost to Oregon State in Berkeley after beating us in L.A.) and Arizona.


NEWS FLASH: The visiting Washington State Cougars just scored a major upset over Washington on the Huskies' home floor, 78-71.


In trying to determine the conference favorite, consider that at this early point in the season, Arizona State has lost to Washington, who lost to Washington State, who lost to Arizona, who lost to UCLA, who lost to Cal, who lost to Oregon State, who lost to Oregon, who lost to Stanford, who lost to USC, who lost to Cal and Arizona. And even though USC lost those two, they beat Stanford, who beat Oregon, who beat Oregon State, who beat Cal, who beat UCLA, who beat Arizona, who beat Washington State, who beat Washington who beat ASU, who beat nobody in the Pac Ten yet. (This makes the genealogy in the first chapter of the gospel of Matthew look pretty simple, doesn't it?) Bottom line: the conference is wide open and there are no guarantees (aside from the proverbial death and taxes, of course). Trying to consistently pick the winners week to week would be tougher than trying to figure out some of life's great mysteries, i.e., why the heck did Reggie Bush lateral that ball in the first quarter of the big game? (Actually, the fact that he played for USC and not Harvard gives us some pretty good clues, so maybe it's not such a mystery after all.)
